Parliament debates issue of electing a judge of Constitutional Court

At the sitting of February 28, the National Assembly debated the issue of electing a judge of the Constitutional Court.

According to Article 166.1 of the Constitution of the Republic of Armenia, the RA General Assembly of Judges proposed Davit Balayan’s candidacy for the vacancy of a judge of the Constitutional Court. The issue was debated in accordance with Article 135 of the Law the Rules of Procedure of the National Assembly.

The President of the Court of Cassation Lilit Tadevosyan presented the candidate's biographical data and work activity.

At the beginning of his speech, Davit Balayan emphasized his meetings with the parliamentary Factions, and then detailed the motives and considerations for self-nomination in the General Assembly of Judges, and then for being elected as a candidate for the judge of the Constitutional Court in a competitive manner. “My professional experience and knowledge in the field of criminal justice will significantly contribute to the establishment of constitutional justice in criminal law issues,” Davit Balayan expressed conviction. The candidate touched upon his professional activity in the judicial sphere, the legality of the judicial acts, the initiative in the matter of legislative reforms, he spoke about the regulations proposed by some provisions of the reformed Constitution, some decisions of the ECHR.

In the Q&A session, the candidate addressed the issues of concern to the MPs, which, in particular, related to the changes in the system after 2018, the constitutional reforms of 2015, the functions of the Constitutional Court, and presented his ideas on the possible constitutional changes and constitutional justice.

As a result of secret voting, Davit Balayan was not elected.
