The Supreme Judicial Council nominated the candidacies for the vacancy of the Judge of the Administrative Chamber of Court of Cassation Arman Tovmasyan, Vahagn Torosyan and Argishti Ghazaryan.

The item was debated at the NA extraordinary session of December 20 by the established order of Article 135

The President of the Supreme Judicial Council Karen Andreasyan presented the biographical data and the activities of Arman Tovmasyan, Vahagn Torosyan and Argishti Ghazaryan.

The candidate Arman Tovmasyan presented his vision on raising the efficiency of the activity of the Court of Cassation. The rapporteur highlighted the creation of the Administrative Chamber of the Court of Cassation as a result of legislative amendments. Touching upon the problems of the institutional character of the sphere, Arman Tovmasyan opined that their right solution will allow raising the efficiency of the administrative justice system in our country. “In our days the first and the main problem is the overloading of the specialized courts in the judicial system, which in some cases is the reason of the main criticism sounding to the address of the Administrative Court: that is: the duration of the terms of the examination of the cases,” the candidate underlined and added that numerous programmes are proposed in solving the mentioned problem and at present, are under implementation related to increasing the number of the judges, the introduction of the procedure of the examination of the cases in written form, etc. In the rapporteur’s opinion, in the administrative justice sphere we shall also observe the problem of the court overload by raising the factors conditioning its emergence, and the undertaking of right steps in their elimination can promote the regulation of the problem.

“The ongoing changes in our country have great influence on almost all spheres of the public life. And the judiciary also remains part of it, and the measured aimed at its improvement require to review numerous approaches and positions regarding the courts and the justice,” the next candidate Vahagn Torosyan underlined. According to him, though now the administrative justice is clearly an established system, nevertheless, there are many problems in the sphere, which need brave and radical solutions. “It is not a secret that in the courts, including by the administrative specialization, there is a problem of overload which in its turn results in unnecessary delays of the examination of the cases. This problem needs comprehensive study and systemized solution. I believe that the increase of the number of complaints and cases under examination is not a result of trust formed in recent years towards the administrative court,” the candidate noted. Speaking about the rise of efficiency of the activities of the administrative bodies, as well as the rooting principle of legality, Vahagn Torosyan considered important that in the process of the administration implementation the judicial practice of the Court of Cassation on the administrative cases will be adopted in compulsory way by the administrative bodies.

The candidate Argishti Ghazaryan mentioned that he agrees with the concerns voiced by the previous candidates, and after that he answered the deputies’ questions.

T he candidate Armen Khachatryan expressed conviction that the main reason of the establishment of illegal decisions and non-valid judicial acts is the lack of time and the overload. “It is simply impossible to imagine the comprehensive and impartial examination with the overload that the courts work now,” the deputy underlined.

On behalf of the NA Civil Contract Faction the Head of the Faction Hayk Konjoryan delivered a speech. He referred to the opposition colleagues’ not taking part in the sitting. The Head of the Faction emphasized the presentation of the candidates not only professional observations from the NA tribune. But also the reference on the philosophy of law. “This tribune is also a good opportunity in order the judiciary will have a dialogue with the society,” the deputy underscored. According to him, there is an issue of authority of the judiciary among the society, and the NA tribune, according to him, is the best opportunity to have a dialogue with the citizen.
