RA Government to Approve Internal Regulation of Probation Service by Legislative Initiative

In the former Criminal Procedure and Penitentiary Codes provisions were designed, according to which, in accordance with which the Medical Committees presented conclusion related to the issues on release from punishment because of severe illness, as well as applying coercion measures of medical character. In this context the RA Deputy Minister of Justice Yeranuhi Tumanyants noted that in the abovementioned codes the authorizing norm had not been distinctly stipulated, according to which, the Government sets the order of creating a Medical Committee.

At present, a need emerged to set a separate provision by law, according to which, the RA Government will approve the internal regulation of the probation service by the presentation of the RA Minister of Justice.

At July 4 extraordinary sitting, the NA Standing Committee on State and Legal Affairs debated in the first reading the package of bills om Making Addenda to the RA Penitentiary Code, on Making Addendum to the RA Criminal Procedure Code and on Making Addendum to the RA Law on Probation.

As the Deputy Minister of Justice informed, the RA Criminal Procedure New Code and the bill on Making Amendments and Addenda to the law on the Arrested and Detained Persons, by which the issues of the authorizing norms had related to the activity order of the medical committees had been already solved. Besides, From July 1 the new RA Criminal Procedure Code entered into force, the need of making abovementioned amendments and addenda in the Code recognized invalid lacks. Thus, the executive body proposes to remove from the submitted package the bills on Making Addenda to the RA Penitentiary Code and on Making Addendum to the RA Criminal Procedure Code.

The co-rapporteur, the deputy Arpine Davoyan noted that the amendment is of technical character and proposed the Committee to give an endorsement.

The Committee approved the draft law on Making Addendum to the RA Law on Probation: it will be included in the agenda of the NA extraordinary session to be convened in the near future.

The draft law on Making Amendments and Addenda to the constitutional law the Judicial Code of the Republic of Armenia authored by the Government was debated in the second reading. The RA Deputy Minister of Justice Grigor Minasyan presented it. It is designed to sue disciplinary proceedings towards the judge with the disclosed violation of the ECHR judgments until 15 years According to the rapporteur, the executive body made specifications, technical editing from the first to the second reading.

The moderator, the Deputy Chair of the Committee Vahagn Hovakimyan underlined that during the debate of the draft law in the first reading at the Committee the deputies’ raised problems were solved. The MP called on his colleagues to vote for the initiative.

The revised draft law was endorsed by the Government.
