At April 29 sitting, the NA Standing Committee on State and Legal Affairs debated the draft law on Making Amendments to the RA Criminal Procedure Code authored by the NA deputies of My Step Faction Nikolay Baghdasaryan, Vahagn Hovakimyan and Viktor Yengibaryan. It is proposed to correspond the procedure and types of arrest envisaged by Chapter 17 of the Code with Article 27 of the Constitution, Article 5 of the European Convention and the requirements set by the case law of the European Court.
According to the key rapporteur Nikolay Baghdasaryan, Article 131 of the Code was rewritten, which clarified a measure of restraint and the procedure for arresting a defendant. At the same time, it is proposed to set that the arrest cannot last longer than 36 hours in case of this type of arrest. It is 72 hours by the current procedure. The authors rewrote Article 130, too.
The co-rapporteur Sergey Atomyan, welcoming the initiative, urged to endorse it.
The RA Deputy Minister of Justice Armen Hovhannisyan who has presented the position of the Government has noted that the proposed solutions are important in the law enforcement practice.
The initiative was endorsed.
