At May 20 sitting of the NA Standing Committee on State and Legal Affairs, the draft law on Making Amendments and Addenda to the Law on Bankruptcy with the enclosed package authored by the NA deputy Artur Davtyan was debated and endorsed.
The creditor is deprived of receiving the opportunity to carry out his demand which has been already recognized and is in the execution phase, in case of debtor’s bankruptcy with the enforcement proceeding by the current legal regulations of law, which is especially disputable in terms of possible violations of the right on the fair trial of a person. So, it is proposed to discontinue all enforcement proceedings which are of non-property character with property confiscation, except of enforcement proceedings referred to the expulsion of a citizen, as well as to the damages caused to honor, dignity or business reputation.
The key rapporteur Artur Davtyan noted that he accepted the proposals presented by the Government.
The draft law will be included in the draft agenda of upcoming regular sittings by the endorsement.
