Regulations on electronic trade are brought to completely new modern level

The current Civil Code clearly regulates the issues on electronic contracts, but the regulations are out of date. The regulations on the contracts being signed by electronic means and in general, on the electronic trade are brought to a completely new, modern level by the drafts. At the same time, from now on the citizen will be protected in the contractual relations with the designing relations. It will be more visible to the consumers, in what relations they enter while signing the contract and what conditions they agree. Distinct guarantees are envisaged for better protecting the consumers’ rights in signing contracts. The RA Minister of Justice Grigor Minasyan noted at May 15 sitting of the NA Standing Committee on State and Legal Affairs, presenting for debate in the second reading the package of the revised drafts on Making Amendments and Addenda to the RA Civil Code, on Making Amendments and Addendum to the law on Trade and Services and on Making Amendments and Addenda to the law on Protection of Consumers’ Rights.

According to the key rapporteur, the abovementioned contract and its conditions are made by the entity. The consumer either joins that contract or refuses to sign it and has an opportunity to negotiate or change the conditions.

“This draft defines regulations, which will protect the consumer’s interests,” the Minister of Justice underlined.

What refers to agreeing any condition while signing the contract through appendix, the Minister mentioned that in the appendix the entity will have an opportunity instead of simply turning the page in the appendix have a distinct picture by pressing the additional button, what conditions he/she will agree with. If any condition is changes in the signed contracts, the citizen will get a notice within the reasonable period of time.

The Minister informed that the Government presented proposals in written form after the first reading, according to which, some editorial amendments were made.

In her co-report the Committee Deputy Chair Arusyak Julhakyan underscored that today, people mainly buy online, as a result of which, additional protection problem emerged, there is need of additional regulations. The co-rapporteur noted that the current regulations don’t give an opportunity to effectively protect the consumers’ rights, and proposing regulations thoroughly describe the opportunities, which are given to the consumers.

Arusyak Julhakyan proposed the Committee to vote for the draft. The package of the drafts was endorsed.
