Addendum to Law on Public Service: Prime Minister’s decisions regarding appointment and dismissal of public office to come into force from moment of publication

The law does not define the relations regulating the moment of assuming and terminating the powers of a person appointed and dismissed from a public office by the Prime Minister’s decision. According to the current law, the member of the Government assumes and terminates his powers from the moment of the publication of the decree of the President of the Republic: the RA Deputy Minister of Justice Armenuhi Harutyunyan stated at the NA plenary sitting during the debate of the draft law on Making Addendum to the Law on Public Service on May 2.

The key rapporteur noted that the law was supplemented with a new clause, according to which the Prime Minister’s decisions on appointment to public office and dismissal from public office come into force from the moment of publication, unless a later date is designed by those decisions.

The Deputy Minister mentioned that the technical correction is necessary, because the omission in the legislation gives rise to various interpretations and various speculations.

The co-rapporteur, the member of the Standing Committee on State and Legal Affairs Karen Sarukhanyan called on to vote for the draft.
