Parliament Debates Issue of CC Judge’s Election

The President of the Republic nominated Hovakim Hovakimyan’s candidacy for the position of the judge of the Constitutional Court (CC). The issue was debated at September 15 sitting of parliament by the order established by Article 135 of the law NA Rules of Procedure.

The Acting Head of Staff Khachatur Poghosyan presented the candidate’s biographical and professional data, after which Hovakim Hovakimyan voiced his observations on main guidelines of the CC activities. He proposed to observe the possibility of stipulation of relevant legal bases in the context of the constitutional reforms, and make the culture of providing opinions of advisory character by the CC component of legally used practice. He proposed also to stipulate by the Constitution the legality of providing official comment on constitutional provisions for improving the Comment Institute. To Hovakim Hovakimyan’s conviction, regulating by the Constitution the legal relations of providing opinions of advisory character and official comments, the mutual respect and cooperation between the bodies of the public power will be strengthened.

The candidate underlined the fact of the legal state is important for an uninterrupted implementation of the provisions of the Constitution and guaranteeing the stipulated criteria, a state that activity of which is based on the principle of the rule of law and as a chief goal adopted the protection and provision of the human and citizen’s rights.

Hovakim Hovakimyan assured that being elected he will have his contribution with work experience and professional skills in the CC judge’s responsible work.

The candidate also touched upon the deputies’ questions, which related to the expediency of the Constitution the legal relations of providing opinions of advisory character and official comments, the opportunity of uniting in one body the CC, the Supreme Judicial Council (SJC) and the Court of Cassation, the steps taken towards the mass media spreading unreliable information, etc.

The CC Judge is elected by secret ballot by at least the three-fifth of the votes of the deputies’ total number.
