Administrative Responsibility to Be Imposed for Not Opening Bank Account in Order to Pay Mandatory and Other Payments Defined by Law on Management of Blocks of Flats in Non-Cash Manner

“The purpose of the proposed amendments is to impose administrative responsibility for not opening a bank account in order to pay mandatory and other payments defined by the Law on Management of Blocks of Flats in a non-cash manner,” the RA Deputy Chairman of the Urban Development Committee Davit Grigoryan , presenting the draft law on Making Amendments and Addenda to the RA Code on Administrative Offenses.

The legislative initiative was debated in the first reading at the NA regular sitting on September 14.

Back in January 2020, the National Assembly adopted the proposed amendments and addenda to the Laws on Management of Blocks of Flats and on Condominium, which stipulated that the owners should pay the mandatory and other payments defined by law in a non-cash manner, separately for each blocks of flats, by making a transfer to the bank account opened for that purpose. According to Davit Grigoryan, summarizing the year-end results, it became obvious that a significant part of blocks of flats have open bank accounts. However, there is a need to impose administrative responsibility for not opening a separate bank account for the blocks of flats by the management body of the blocks of flats in the amount of ten times the minimum salary, and if the same act has been committed again within one month after the application of administrative penalty measures, in the double amount of fine set for each violation.

The member of the Standing Committee on Territorial Administration, Local Self-Government, Agriculture and Environment Protection Sergey Bagratyan presented the endorsement of the Head Committee on the draft.
