Agreements Regulating Tax Legislation Debated

The agreement on Accruing and Distributing the Sums of Importing Customs Duties (adequate to other duties, taxes and payments), on Holding Joint Control Measures Directed to the Issues of Preserving Order of Transferring to the Budget of the Eurasian Economic Union Member States Will Regulate the Control towards Collecting and Distributing the Customs Duties by the Supreme Control Bodies of the EEU member states. It is proposed to regulate the goals, principles and procedures of the implementation of the joint control measures. To hold joint control measures a programme of the implementation of the joint measures will be compiled, which will elaborate the financial control supreme body of the EEU member state, which chairs in the EEU bodies in implementing joint control measure.

The respective bodies of the EEU member state are obliged to eliminate the disclosed violations and inform about this to their governments and supreme bodies implementing financial control.

The RA Deputy Minister of Finance Arman Poghosyan presented the proposing regulations by the Agreement at September 12 NA regular sitting.

The NA Standing Committee on Regional and Eurasian Integration endorsed the issue under debate. The Committee member Aleksey Sandikov informed about this.

The RA Deputy Minister of Finance also presented for debate the bill on Ratifying the Multilateral Convention to Implement Tax Treaty Related Measures to Prevent Base Erosion and Profit Shifting.

Fight is designed against the phenomena avoiding taxation through aggressive international tax planning. The legislation will give an opportunity to take the profits in the country, where real economic activity is organized and real new value is created. While building bilateral tax relations the countries will not be obliged to make changes in the bilateral agreements signed between each other every time. According to Arman Poghosyan, this is an opportunity to avoid every time to re-negotiate on the this or that provision of the agreements. “Joining this multilateral Convention, we’ll get a right to apply those regulations within the framework of our tax administration,” the Deputy Minister said.

The member of the Standing Committee on Economic Affairs Hovik Aghazaryan presented the endorsement of the Committee.

Arman Poghosyan, presenting the draft law on Ratifying the Protocol amending the Convention of 12 June 2006 between the Republic of Armenia and the Swiss Confederation for the avoidance of double taxation with respect to taxes on income and on capital, noted that the protocol signed on November 12, 2021 has an aim to update the Agreement in force between Armenia and Switzerland. According the substantiation, the adoption of the protocol does not require need of financial means, and conditioned by its adoption, there won’t be essential decrease of state budget incomes or increase of expenditures.

The NA Standing Committee on Economic Affairs endorsed the draft.
