If Identity of Citizen is Not Confirmed Within At least One Month from Moment of Death, It is Proposed to Consider Opening Day of Inheritance as Day of State Registration of Death

On January 11, at the sitting of the NA Standing Committee on State and Legal Affairs, the proposed addendum to the Civil Code of the Republic of Armenia was debated in the first reading. The deputies of the NA Civil Contract Faction Tatevik Gasparyan, Lena Nazaryan and Narek Babayan authored the initiative.

The key rapporteur Lena Nazaryan has noted that according to the legislation, the inheritance can be received within six months from the date of death of a citizen. However, in Lena Nazaryan’s opinion, in that case, when a person dies within a specific known period and the identity of a dead person is not found out within six months, it becomes very difficult to receive an inheritance, as the heir misses the opportunity to apply to a notary to receive an inheritance within six months. “This is a problem faced by the relatives of the persons who died in the war started on September 27, 2020 and whose identities have not been clarified for a long time,” the deputy added.

The co-author has presented the revised version of the draft, according to which, if the identity of the citizen is not confirmed within at least one month from the moment of death, the opening day of the inheritance will be considered not the day of death, but the day of state registration of death. Regulation will not apply to those cases when, as of the day the law enters into force, there is already an application submitted to the notary on receiving an inheritance or a certificate of inheritance.

The co-rapporteurs, the deputy Artur Davtyan and the representative of the Government, the RA First Deputy Minister of Justice Kristinne Grigoryan, welcomed the initiative and urged them to vote in favor.

As a result, the law will also apply to inheritance relationships of heirs who died after September 27, 2020.

The revised version of the draft was endorsed.
