Amendments Being Proposed to Procedure Codes Approved by Committee

On June 9, the regular sitting of the NA Standing Committee on State and Legal Affairs moderated by Vladimir Vardanyan was held.

The Committee debated in the first reading draft law on Making Addendum to the RA Criminal Procedure Code with the package authored by the Government.

The RA Representative to the European Court of Human Rights Yeghishe Kirakosyan presented the proposing regulations and amendments. It has been noted that it is proposed to add the relevant articles of the codes with the provisions, according to which, as a basis of revision of criminal, civil and administrative cases in the inner-state courts the reconciliation agreement reached between the parties or the one-sided statement approved by the European Court are designed.

The amendment is inclined to make the RA legislative regulations consonant to the assumed international obligations, becoming an additional guarantee for the persons’ rights and full ensuring of freedoms.

It was noted that the legislative package had passed a long phase of discussion. It was also agreed with the judicial power.

The basis of the case revision will get more distinct stipulation with the new circumstances designed by RA Criminal Procedure, the RA Civil Procedure and the RA Administrative Procedure Codes. Particularly, the case will be revised not only by the judgment or the decision entered into force by the international court functioning on the basis of the RA ratified international treaty or by the decision in case of the fact of violation of the person’s right not being designed by the RA ratified international treaty, but also in case, when reconciliation agreement will be established between the parties or the Republic of Armenia will make a one-sided statement.

In his co-report Vladimir Vardanyan has noted that the presented draft law is of importance for the fulfilment of the obligations assumed by the European Convention of Human Rights and guaranteeing the right to the RA citizen’s judicial protection.

The package of the draft laws was endorsed.
