At March 18 sitting of the NA Standing Committee on State and Legal Affairs, the RA Minister of Justice presented the revised version of the draft law on the RA Criminal Code.
It is proposed to make key amendments to the Fine Institution. A new category of calculations of fines was stipulated. The monthly income of a person is the base of calculations of fines, the average of which is 35% of monthly income received by the person during 12 prior months to the date of crime.
It is proposed not to overload the state system with additional new links and define that social programmes can be implemented to compensate the victims of crime at the expense of the state finance every year. The provisions on the institutions of confiscation of a criminal property, a tool, means or object were improved. The amount of the subject of confiscation of a criminal property cannot be less than 75% of the total value of confiscation of the subject of a criminal property.
The bill envisages to invest a system of punishments and an institution of criminal responsibility for legal entities.
“The preference was given to criminal responsibility in the bill, but the regulations were improved and chosen by the logic that the fight against a crime and development and boost of the economy would be balanced and not to exclude each other,” the minister underlined.
The institution of release from a punishment was improved, especially not to apply a punishment conditionally, replacing part of escaped punishment with milder kind of punishment was reviewed.
The MP Sergey Atomyan proposed to vote for the co-report.
The draft law was endorsed.
