AMENDMENTS TO THE CONSTITUTION OF THE REPUBLIC OF ARMENIA

Article 1. Article 213 of the Constitution of the Republic of Armenia of July 5, 1995, with the amendments of December 6, 2015, shall be edited as follows:

“Article 213. The tenure of the members (judges) and the President of the Constitutional Court

1. The term of office of a member of the Constitutional Court (judge), appointed before the entry into force of Chapter 7 of the Constitution and holding the office of a member of the Constitutional Court or a judge for a total term of 12 years or more, shall be considered terminated and his/her term of office shall terminate.

2. Prior to the entry into force of Chapter VII of the Constitution, the appointed member of the Constitutional Court, whose term of office shall not terminate by virtue of part 1 of this Article, shall continue to hold office as a judge of the Constitutional Court until he occupies that office for 12 years, taking into consideration before the entry into force of Chapter VII, as well as the term of office after the entry into force of Chapter VII of the Constitution.

3. After the entry into force of Chapter 7 of the Constitution, the nominations for the vacant positions of judges of the Constitutional Court shall be made successively: the Government, the President of the Republic and the General Assembly of Judges. Nominations for vacant offices for a judge of the Constitutional Court arising on the basis of part 1 of this Article shall be implemented within two months after there is a vacant office.

4. The term of the office of the President of the Constitutional Court shall be terminated. After the vacancy of the office of the President of the Constitutional Court, the President of the Constitutional Court shall be elected in accordance with the procedure established by Article 166 of the Constitution, which shall be implemented after the staffing of the vacancies of judges of the Constitutional Court caused by the basis of part 1 of this Article.”

Article 2. Amendments to this Constitution shall enter into force on the day following its official publication.
