Roundtable Discussion on the Draft Law NA Rules of Procedure

On December 8, the RA NA Standing Committee on State and Legal Affairs and the OSCE Office in Yerevan organized roundtable discussion on the constitutional draft law NA Rules of Procedure. The NA deputies, OSCE/ODIHR experts, and representatives of the OSCE Office in Yerevan took part in the discussion.

In his welcoming word the Committee Chair Hovhannes Sahakyan presented the agenda and the priorities of the items under debate. Mr Sahakyan thanked the OSCE Office in Yerevan for continuous support and joint work, underlining that as a result of it expertise conclusions had been presented over numerous items.

The Deputy Head at the OSCE Office in Yerevan Barbara Davis in her welcoming remarks has highlighted the amendments under proposal and the fact that the draft law is debated with the participation of all concerned parties. To her assessment, the NA Rules of Procedure bill is a key document for a new system of the state government and expressed hope that the OSCE/ODHR remarks will be necessary.

Hovhannes Sahakyan presented the main provisions of the draft law the RA NA Rules of Procedure and the work done. It has been noted that the working Group created in January of this year had been in Germany and England, studied the experience of the European countries, and cooperated with the OSCE Office in Yerevan. Mr Sahakyan noted that as a result of debates in the first reading some disputable issues had been distinguished, which particularly related to the NA deputy’s removal from the faction or getting out of the faction and conditioned by that fact the right or permission of putting down the mandate, the time restriction of the deputies’ speeches, the Insvestigating Committee’s activities and the authorities.

The OSCE expert, Professor of Law St John Bates (Great Britain) presented the OSCE/ODIHR conclusion. He referred to the parliamentary experience of Germany, Great Britain, Lithuania, Latvia, Finland, Canada, Estonia, Bulgaria and a number of other countries and made parallels. Mr Bates opined that Rules of Procedure should be of practical nature and give opportunity of getting clarifications on a series of questions. The Professor has underlined that the draft law is a welcoming step in terms of harmonisation of legislation.

In Q & A session the NA deputies voiced a number of interpellations, on which Professor St. John Bates presented clarifications. The questions related to the control functioning, the procedure of the debate and adoption of the National Assembly, his Committees and Factions, the role of the parliament’s staff and the legal and political basis of the NA deputy’s dismissal, its political consequences, the right of making legislative initiative, the organization of the debates at the NA Standing Committees and the plenary sitting, the debates of the items in speedy procedure, the provisions of the activities of the Sub-Committees and a number of other provisions.

In his final speech the Chair RA NA Standing Committee on State and Legal Affairs Hovhannes Sahakyan has considered effective the debates of such format, during which numerous issues are debated and an opportunity is given to have more documented legislative initiative.
