Government has right to take back property attached by it to CNCO, and CNCO does not have right to alienate, pledge, or hand over attached property or its rights to it for free use on initiative

The draft law on Making Addendum to the Law on State Non-Commercial Organizations (SNCOs) proposes to regulate the process of providing property to Community Non-Commercial Organizations (CNCOs) with the right to use it free of charge.

According to the key rapporteur, the Head of the RA State Property Management Committee of the Ministry of Territorial Administration and Infrastructure Arnak Avetisyan , the problem is that the process of providing property to Community Non-Commercial Organizations with the right to free use is not regulated by law.

Taking into consideration the above mentioned, the current law is supplemented by the new Article 5.1, according to which, by the decision of the Government, any property can be attached to a community non-commercial organization with the right to use it indefinitely and free of charge.

Accordingly, the Government has the right to take back the property attached by it to the Community Non-Commercial Organization, and the CNCO does not have the right to alienate, pledge, or hand over the attached property or its rights to it for free use.

The Deputy Chair of the NA Standing Committee on Territorial Administration, Local Self-Government, Agriculture and Environment Protection Aren Mkrtchyan presented the endorsement of the Head Committee. Highlighting the adoption of the draft, he called on his colleagues to vote for it.
