In accordance with the relevant article of the law on Foreigners, the foreigners can work without permission of work in the representation of only the foreign legal person situated in the Republic of Armenia. It means that in the branch of the given organization the foreigner should pass an additional process for the working permission in the branch of the given organization. An MP Gevorg Papoyan proposes to make an addendum and add the word ‘branch.’ He underlined that the legal position on the discriminative attitude towards the person of the Constitutional Court.

“Such discriminative and differentiated approach has no objective basis, is not legal, as the legal status of the branch and the representation, is almost identical. One of the international organizations often opens a representation, another one – a branch,” the deputy said.

According to Gevorg Papoyan, the representation and the branch are subdivisions separated by the legal person, but the branch carried out wider functions than the representation.

The Committee Chair Vladimir Vardanyan agreed with the author that the amendment can have positive impact in terms of the investment development, and the liberalization process will be effective. He touched upon the problems conditioned by the branch in organizational-legal way, noting that problems appear in the state register on the branches, and it is distinct in case of representation.

As Gevorg Papoyan assured, as a result of the preliminary consultation with the RA Ministry of Justice it was approved that there is no problem in legal aspect.

In her co-report Lilit Minasyan positively assessed the proposing amendment.

In the opinion of the RA Deputy Head of the Migration Service Irina Davtyan, if the employee of the representation is discharged from the demand of the work permission, then the employees in the branch also should discharged. It was noted that the executive body has not objections and proposals.

The issue was debated in the first reading and endorsed at sitting of the NA Standing Committee on State and Legal Affairs on November 8.

The debate of the legislative package on Making Amendments and Addenda to the law on State Registration of the Legal Persons, on State Accounting of the Separated Subdivisions of the Legal Persons, Institutions and Individual entrepreneurs was postponed up to two months.
