Arpine Sargsyan: Current laws and secondary regulatory legal acts will be harmonized with RA new Criminal Code

The RA new Criminal Code will enter into force from July 1, 2022. The Criminal Code adopted on April 18, 2003, will be recognized invalid from that moment. Before the entry into force of the Code, the other current laws and the secondary regulatory legal acts in the RA territory are subject to harmonization with the RA new Criminal Code. The RA Deputy Minister of Justice Arpine Sargsyan said about this during the presentation of the draft on Enactment of the RA Criminal Code at the NA sitting on May 24.

It is envisaged that the persons convicted by the Criminal Code adopted on April 18, 2003 until July 1, 2022, whose actions are no longer considered crimes according to the new Criminal Code will be exempted from the main and additional punishments.

The rapporteur said that it is proposed to exempt the persons from the type of punishment “confiscation of property” against whom the verdict entered into force until July 1, 2022, however, the sentence has not been carried out or the verdict has entered into force, but no confiscation has taken place as of July 1. “In fact, the privilege will be used by those persons for whom the confiscation act has not been made yet,” the Deputy Minister said.

The Chair of the Standing (Head) Committee on State and Legal Affairs Vladimir Vardanyan presented the endorsement of the Committee.

According to the RA Deputy Minister of Justice Arpine Sargsyan, the legislative package envisaging amendments and addenda to the Constitutional Law on RA Judicial Code authored by the Government was also debated in the first reading. It is expected to harmonize the RA legislation with the Criminal Code and the Criminal Procedure Code and fill the gaps in them.
