Parliament Debates Bill Regulating Process of Receiving Inheritance

At January 17 RA NA regular sitting, the draft law on Making Addendum to the RA Civil Code authored by the deputies Tatevik Gasparyan, Lena Nazaryan and Narek Babayan was debated in the first reading.

According to the key rapporteur Lena Nazaryan, the need for a legislative initiative arose during the visits to the families of more than one hundred fallen servicemen with her colleague Tatevik Gasparyan. During the meetings, it has been found out that there are problems related to receiving inheritance. According to the current legislation, the inheritance can be received within six months from the date of death of a citizen. However, according to Lena Nazaryan, when a person dies within a specific known period and the identity of a dead person is not found out within six months, it becomes very difficult to receive an inheritance, as the heir misses the opportunity to apply to a notary to receive an inheritance within six months. This problem has been faced by the relatives of the persons who died in the war started on September 27, 2020 and whose identities have not been clarified for a long time. With the proposed amendment, if the identity of the citizen is not confirmed within at least one month from the moment of death, the opening day of the inheritance will be considered not the day of death, but the day of state registration of death. Regulation will not apply to those cases when, as of the day the law enters into force, there is already an application submitted to the notary on receiving an inheritance or a certificate of inheritance.

The co-rapporteur, the member of the RA NA Standing Committee on State and Legal Affairs Artur Davtyan presented the positive conclusion of the Head Committee and called on to vote in favor. The representative of the Government, the RA First Deputy Chair of Justice Kristinne Grigoryan underlined the importance and urgency of the adoption of the initiative.
