NA Draft Decision Proposed by Opposition Debated

At October 27 NA sitting, the parliament debated the NA draft decision proposed by the NA Armenia and With Honor Factions on Setting the Number of the Inquiry Committee for Studying the Facts Hindering a Fair Trial for Cases Initiated in Courts in Violation of the Distribution Procedure Established by Law, as well as Disciplinary Proceedings Initiated by the Minister of Justice against Judges.

The representative of the initiative group Aram Vardevanyan has noted that the Inquiry Committee will study the cases in violation of the distribution procedure established by law. As the rapporteur has said, it is defined in the Judicial Code that if the computer programme is failed then the Supreme Judicial Council debates the reasons and gives mandatory instructions to the Judicial Department to eliminate them. “The Judicial Department is a state body over which the National Assembly can exercise control,” Aram Vardevanyan underlined. One of the goals of the Committee activities is the implementation of the NA control function.

The disciplinary proceedings initiated by the Minister of Justice on November 1, 2020 and the logic of their initiation will also be the subject of the Inquiry Committee.

The Inquiry Committee will have 10 members by the draft,

Artsvik Minasyan gave a speech on behalf of the NA Armenia Faction. According to the Secretary of the faction, the legislative body should ensure the precise implementation of the laws set by them. The public should be informed whether the right to the fair trial has been violated and whether the courts act in accordance with the spirit of the law or not.

Vladimir Vardanyan gave a speech on behalf of the NA Civil Contract Faction. He has stated that respecting the opposition’s right to exercise the constitutional authorities, he thinks that it is not allowed to violate the law. According to Vladimir Vardanyan, the parliament cannot take over the functions of the body carrying out justice. “We consider this process unconstitutional, and it is not substantiated in any way. We will not participate in this process,” the deputy noted.
