Legislators Debate Candidacies Nominated by SJC for Electing Judge for Court of Cassation

“Arsen Mkrtchyan is a judge with multi experience and enjoys the colleagues’ respect in the judicial power,” The Chairman of the Supreme Judicial Council (SJC) Ruben Vardazaryan said presenting to the parliament the biographical data and professional qualities of one of the candidates Arsen Mkrtchyan.

In response to the MPs’ questions on the statement sounded on November 15, Ruben Vardazaryan said, Ruben Vardazaryan said: “That is the statement, call made by the SJC Chairman, and it is not agreed with SJC members.”

Meanwhile Nikolay Baghdasaryan has insisted that the SJC has no right to present his personal opinion on behalf of the SJC, the latter is a state official, and the SJC is a collegial body. “You have speculated your authorities,” the MP underlined.

That statement damaged the security of our country and the inner stability: Andranik Kocharyan opined like that. He called on Vardazaryan to keep the judicial system far from the influences damaging the stability of the country. In response to that, it was noted: “I will follow your call and will spare no effort to keep the judicial system from any political influence.”

The candidate for the Judge of the Court of Cassation Arsen Mkrtchyan to touch upon the positive and negative factors taking place in the judicial power.

“In the judicial power we have good representation of generations, free, clever mind, but we don’t have wide public perception of fair court. We have constitutional justice, reasoned judicial acts, but the public has final expectation of justice from the European Court of Human Rights (ECHR). We have baseline foundations in terms of justice quality and negative – in terms of public perception,” the candidate said.

At March 3 sitting, the SJC Chairman Ruben Vardazaryan also introduced the biography and the work experience of the candidate for the Civil and Administrative Chamber of the Court of Cassation, Doctor of Legal Sciences Armen Haykyants. Haykyants informed the parliament his observations over certain aspects of the justice mission in the framework reserved to the Court of Cassation.

“In the last three decades, undoubtedly the status of the Court of Cassation since the RA independence is the result of the constructive development of Armenia’s legal system,” Armen Haykyants said.

The debate of the item will continue at tomorrow’s sitting of the parliament.
