Legislative Initiative Takes into Account Features and Principles of Service in National Security Bodies

The need to develop a package of draft laws on Making Amendments and Addenda to the Law on Service in the National Security Bodies and on Making Amendments and Addenda to the Law on National Security Bodies is due to the need to harmonize the concepts used in the law with the current legislation and clarify the powers of the national security service in the field of information security. The legislative initiative was debated in the second reading at the extraordinary sitting of the RA NA Standing Committee on Defense and Security on November 24.

The RA NA Armenia Faction submitted a proposal in the package of the above-mentioned draft laws between the first and second readings. It was proposed to amend the first Article of the draft law on Making Amendments and Addenda to the Law on National Security Bodies. In particular, a rchive materials of the authorized body can be destroyed in accordance with the law and other legal acts after declassification. “The proposal is not acceptable, because the relations regarding the declassification and destruction of information constituting state and official secrets are regulated in detail by the Law on State and Service Secret and the secondary regulatory acts arising from the law,” The Deputy Director of NSS Andranik Simonyan explained, justifying it with the articles of the current law. “The amendment made by the draft presented by us, in fact, is aimed at clarifying the existing legal formulation and does not imply any new regulation for the mentioned relations,” the RA Deputy Director of the National Security Service summarized.

The MPs of the NA Armenia Faction Gegham Manukyan and Gegham Nazaryan expressed concern about the amendment proposed to Article 8.3 of the legislative initiative, namely: Archive materials of the authorized body are declassified and destroyed in accordance with the law and other legal acts.

In his speech, Armen Khachatryan thanked for the meaningful debate, noting that the content of the draft refers to the personnel policy. At the same time, the draft also proposed to a legal correction.

The Committee endorsed the revised draft.
