Addenda and Amendments to Constitutional Law on Parties

In 2020, the National Assembly passed the draft law on making Addenda and Amendments to the constitutional law on Parties, on making Addenda to the Law on Corruption Prevention Commission and on Amending a number of Co-Laws, and their main aim was the establishment of the party system, the provision of financing transparency and publicity, the separation of the political activity and business and the political corruption prevention.

One of the key amendments of the package of draft laws was passing the control function towards the current financial activity of the parties from the Supervision Service of the Central Electoral Commission to the Corruption Prevention Commission. It implies checking of trustworthiness and integrity check of the available information and the date in the financial means sources and expenditures of the parties by the Committee, as well as the preservation of the requirements of the launch report. On January 1, 2022 was set for entering into force the provisions regarding the Committee functions.

Providing new functions to the Committee requires replenishment of human resources, appropriate software, as well as elaboration of appropriate sub-legislative acts. However, the time designed by law has not been sufficient for providing full implementation of the above-mentioned events. Hence, it is proposed to postpone the terms of assuming, terminating the declarant persons’ post, as well as presenting the annual declarations of the parties until May 31, 2022.

According to the Deputy Minister of Justice Yeranuhi Tumanyants, the legal regulations of the authorities given to the Corruption Prevention Commission arose necessity for specification.

“The draft proposes to simplify the procedure of providing the necessary information to the Commission, reserving the list of necessary information for clarifying the circumstance of being subject to the audit organization, as well as the party annual report obligatory audit and the authority of the definition of their presentation form,” the Deputy Minister noted.

The legislative package was debated during the NA regular sitting on May 3.
