Amendments Proposed to Code on Administrative Offenses

At the sitting of the NA Standing Committee on State and Legal Affairs, the RA Deputy Chairperson of the State Revenue Committee Tsovinar Soghomonyan presented for debate in the first reading the draft law on Making Addenda and Amendments to the RA Code on Administrative Offenses.

With the adoption of the draft, the right to drop or extend the administrative proceedings by the RA State Revenue Committee will be defined and the term of imposing administrative penalty with dropped or extended administrative proceedings will be clarified.

It is proposed to not include the terms of dropping or extension in the general terms of imposing administrative penalty in case of dropping or extending the administrative proceedings by set order and terms established by law on Bases of Administration and Administrative Proceedings. Tsovinar Soghomonyan has clarified that the implementation of proceedings on state budget taxes and payments will be reserved to the Tax authority, and the implementation of proceedings on local taxes and payments – to the Local Self-Government bodies.

In his co-report, the Committee Chair Vladimir Vardanyan has expressed an opinion that the proposed amendments give an opportunity to introduce legal certainty between the administrative proceedings and the institutions of holding a person liable during it. The Committee Chair has highlighted the initiative, underlining that it will provide a joint practice for law enforcers. He has submitted proposals and has noted that appropriate corrections will be made in the first to the second reading.

The Committee endorsed the initiative.
