National Assembly of the Republic of Armenia
of #1 of May 26 of 2017

WORK PROCEDURE

OF THE COUNCIL OF THE NATIONAL ASSEMBLY OF THE REPUBLIC OF ARMENIA

1. The Council of the National Assembly of the Republic of Armenia (hereinafter: Council), shall exercise its powers, prescribed by the Constitutional Law of the Republic of Armenia "Rules of Procedure of the National Assembly" (hereinafter: Rules of Procedure), in accordance with the Rules of Procedure, the Work Procedure of the National Assembly and the present Work Procedure.

2. The sittings of the Council shall take place at the residence of the National Assembly. A sitting of the Council may take place in another location at necessity by the decision of the Council, and if that is impossible, by the decision of the Chairperson of the National Assembly.

3. The initiative of at least one quarter of the total number of members of the Council to convene an extraordinary sitting of the Council shall be implemented by an official letter addressed to the Chairperson of the National Assembly, stating the agenda of the extraordinary sitting and the date it will be held. The draft agenda issues shall be attached to the official letter. If the official letter or any agenda issue:

  1. ) Does not correspond with the prescribed requirements and within a working day is not brought into comply with them, then the Chairperson of the National Assembly shall return the official letter and the documents regarding to the certain agenda issue, specifying the reasons.
  2. ) corresponds, then the Chairperson of the National Assembly, by the prescribed agenda of the initiator, and within the required term, shall convene an extraordinary sitting of the Council.

4. The members of the Council shall be notified about the convening of a regular sitting of the Council no later than three working days in advance, and about the convening of an extraordinary sitting no later than three hours in advance. Council members shall be notified of the Council sitting in another place at least one day before the sitting. The Staff of the National Assembly (hereinafter the Staff) shall send an e-mail to the members of the Council announcing the convening of the sittings of the Council.

5. The members of the Council present at the Council sitting shall be registered by the Staff.

6. At the beginning of the sitting in case the authority of the Council sitting is ensured, the officer presiding over the sitting shall announce that the sitting is open. If the number of registered members of the Council is not sufficient for the authority of the sitting, the registration shall continue until the required number of members of the Council is registered, but not more than two hours. In case of jurisdiction of the sitting within the mentioned period:

  1. ) is ensured, the officer presiding over the sitting shall inform the members of the Council about the beginning of the sitting;
  2. ) is not ensured, the sitting of the Council shall be considered not to have taken place.

7. The Chairperson of the National Assembly shall submit to the Council for a debate the draft decisions regarding the implementation of the powers of the Council defined by Part 1 of Article 28 of the Rules of Procedure, with the exception of paragraph 9. The other members of the Council shall have the right to submit to the Council for a debate the draft decisions on the implementation of the powers defined by Part 1 of Article 28 of the Rules of Procedure, with the exception of paragraphs 1, 9, 13 and 14.

8. The issues envisaged by paragraph 2 of part 7 of Article 41, paragraph 2 of part 8 of Article 44, part 3 of Article 49, part 6 of Article 52, part 5 of Article 58, by part 2.2 of Article 146 and by part 3 of Article 162 of the Rules of Procedure may be submitted to the Council for a debate by a competent person or body.

9. The members of the Council have the right to submit to the Council for debate a draft regarding an amendment to the decision of the Council.

10. The draft agenda of the regular sitting of the Council, as well as the extraordinary sitting convened on its initiative, shall be submitted to the Council for debate by the Chairperson of the National Assembly, and the draft agendas of the other extraordinary sittings shall be submitted by the representatives of the initiators of those sittings.

11. The officer presiding the sitting of the Council shall have the powers prescribed by Article 52 of the Rules of Procedure, so far as they are applicable for presiding the sitting of the Council.

12. At the regular sitting of the Council, as well as at the extraordinary sitting convened on the initiative of the Chairperson of the National Assembly, the sequence of debated issues shall be decided by the officer presiding over the sitting, and the sequence of debated issues of the other extraordinary sittings shall be decided by the representatives of the initiators of those sittings.

13. At the sitting of the Council the issues shall be debated in accordance with parts 1 and 2 of Article 55 of the Rules of Procedure. There shall be no related report.

14. Persons wishing to ask questions or take the floor shall apply to the officer presiding over the sitting of the Council. The questions shall be asked as well as those taking the floor shall act in succession by the announcement of the officer presiding over the sitting, who shall announce the name and the last name of the next person taking the floor.

15. During the debate of the issue:

  1. ) Up to ten minutes are allocated for the report;
  2. ) up to two minutes are allotted for answering questions as well as for responding to them;
  3. ) up to five minutes are allocated for speeches;
  4. ) Up to one minute is allocated for speeches regarding the procedure of conducting the sitting.

16. The time shall not be limited for the officer presiding over the sitting for taking the floor, for questions, for answering them, as well as for responding.

17. Voting shall be carried out by raising a hand. The Council member shall vote personally for, against or abstain. During the voting the votes shall be counted by the officer presiding over the sitting. It is prohibited to address the officer presiding over the sitting at the moment of voting.

18. If more than one draft or proposal has been submitted regarding the issue on a debate at the sitting of the Council, then they shall be put to a vote in accordance with paragraphs 3-7 of part 3 of Article 112 of the Rules of Procedure.

19. Council sittings shall be recorded by the Staff. The minutes of the Council sitting shall be signed by the officer presiding over the sitting.

20. By the proposal of the Chairperson of the National Assembly or the author of the agenda issue of the sitting of the Council, the Council may establish a special procedure for the debate of the issue. A proposal to establish this procedure shall be submitted before the debate of the issue. The number of those giving questions and taking the floor may not be limited by a special procedure, or the time limits of the terms established by paragraph 15 of present Work of Procedure may not be reduced.
